Whenever possible we recommend parties use mediation to come to settlement for both the arrangements concerning the children and the financial settlement. Mediation is a process we can lead to a successful outcome.
The primary reason is that both parties have control over the final outcome of the divorce and do not have to live with the final judgement of the court, a judgement they may not agree with or like.
Divorce itself is emotionally draining and an incredibly stressful time. The sooner it ends the sooner you can get out there and rebuild your life. This is also true for any children involved, who will be looking for certainty and wondering how their lives will be affected.
Courts require a certain process be followed, which is often frustrating. A good deal of the process does not deal directly with the terms of the settlement, for example administrative court hearings and paperwork. The use of barristers in court for administrative hearings and settlement hearings also costs an enormous sum of money.
